Terms of Service

1. Scope and acceptance

These Terms govern access to and use of Snaaail, including purchases, subscriptions, creator sales, payments and related services. By creating an account, publishing an offer or placing a paid order, you accept the version presented at that time. Mandatory legal rights always prevail over any conflicting provision.

2. Snaaail's role and contracting parties

Snaaail provides an online marketplace and tools for discovery, subscriptions, order management and payment facilitation. Unless an offer expressly states otherwise, Snaaail is not the Creator, seller, manufacturer or postal carrier.

The sales or subscription contract is between the Member and the Creator identified on the offer. The Creator sets the offer, price and shipping terms and remains responsible for fulfilment, legality and consumer obligations.
Payments are processed by Stripe for the relevant Creator. Snaaail may act as the Creator's disclosed agent for payment support, cancellations, refunds, disputes and enforcement of these Terms.

3. Eligibility and accounts

You must have legal capacity to enter into a contract. Creators must be at least 18 and authorized to act for any represented business.

You must provide accurate, current information, including your identity, professional or non-professional status, contact, tax, payment and delivery details, and update it promptly.
You are responsible for activity under your account and must promptly report unauthorized access. We may request identity or business verification before enabling sales or payouts.

4. Subscriptions, renewal and cancellation

A subscription purchases the recurring benefits described in the Creator's offer for each paid billing period.

Subscriptions are billed monthly and renew automatically until canceled. Before checkout, the offer shows the content price, shipping, currency, frequency, expected schedule and any relevant cutoff.
By subscribing, the Member authorizes Stripe to charge the displayed recurring amount, including shipping and applicable taxes, on each billing date until cancellation takes effect.
A Member may cancel at any time through the account dashboard or secure email management link, including without a Snaaail account. Cancellation takes effect at the end of the current paid period, no later recurring charge is made, and the Creator must still fulfil every benefit already paid for.
A price or material plan change applies only prospectively after clear notice. Where the Member's consent is required, the subscription will not continue at the new price without it. The Member may cancel before the change takes effect.

5. Creator fulfilment obligations

The Creator is the seller and is directly responsible to the Member for every advertised and paid benefit.

The Creator must produce and dispatch on the advertised schedule all letters, products and other benefits paid for, in the quantity, quality and condition described in the offer.
Canceling or removing a club, plan or account never releases the Creator from orders or subscription periods already paid. Those benefits must be fulfilled or lawfully refunded.
If fulfilment will be late or impossible, the Creator must promptly inform affected Members and Snaaail, offer the remedy required by law and, where delivery cannot be completed, arrange the applicable refund.
The Creator is responsible for product safety, accurate descriptions, packaging, customs declarations, prohibited-item rules, postage and all local and international laws applicable to the offer and shipment.
The Creator must keep reliable fulfilment and postage records and cooperate promptly with support requests, refunds, payment disputes, recalls and regulatory inquiries.

6. Shipping and delivery

The offer and checkout state the expected dispatch schedule, destination availability, price and shipping charge. The Creator must comply with those commitments and applicable delivery law.

Members must provide a complete, accurate and deliverable address before the displayed cutoff and update it through the available management tools. Extra costs caused solely by an incorrect or late-updated address may be charged where lawful.
Where mandatory consumer law applies, risk remains with the professional seller until the Member or their designated recipient physically receives the goods. A postal carrier's delay does not remove the Creator's mandatory obligations.
For missing, damaged, materially late or non-conforming deliveries, the Member must contact the Creator or Snaaail promptly. The responsible Creator must provide redelivery, repair, replacement, price reduction, cancellation or refund when required by applicable law.

7. Fees, payouts and taxes

Fees applicable to a transaction are disclosed in the Creator dashboard or checkout and recorded when the payment is created. We do not retroactively increase the fee on a completed transaction.

Unless a different rate is clearly agreed or displayed before sale, the default Snaaail platform fee is 8% of the content price and shipping charged to the Member. It is deducted automatically from the Creator's proceeds.
Stripe payment-processing and payout fees are separate from Snaaail's fee. Stripe processing fees may remain a Creator cost after a refund; this never reduces a consumer refund required by law.
The Creator is responsible for refunds, reversals, disputes, chargebacks, penalties and negative balances attributable to their offers or breach. Snaaail may recover or offset those amounts against current or future payouts where permitted by law.
Creators are solely responsible for determining, collecting, reporting and paying taxes, duties, registrations and social contributions arising from their activity, except amounts that Snaaail is legally required to collect or report.

8. Cancellation, withdrawal and refunds

Cancellation of renewal, statutory withdrawal and a remedy for non-delivery or non-conformity are different rights. Nothing in these Terms limits a Member's mandatory rights.

When the Creator is a professional and the Member is a consumer, the Creator must provide all applicable legal guarantees and remedies for non-conforming or undelivered goods and services.
For eligible distance contracts, EU and French consumers generally have 14 days to withdraw without giving a reason. For a contract for regular delivery of goods, that period generally starts on receipt of the first good. Instructions may be requested from the Creator or support@snaaail.com.
The withdrawal right may not apply to goods genuinely made to the Member's specifications or clearly personalized, and other statutory exceptions may apply. A Creator must not claim an exception unless its legal conditions are actually met.
Refunds approved or required are returned through the original payment method wherever possible. Bank processing may take additional business days. Snaaail may process a refund for the Creator and recover the corresponding amounts from the Creator.
Canceling an auto-renewal normally prevents future charges but does not automatically refund a period already paid or cancel an order already committed for fulfilment. Statutory withdrawal and remedies for non-delivery, delay or non-conformity remain available.

9. Restriction, suspension and platform action

We may protect Members, Creators, Snaaail and payment systems by restricting content, payments, payouts or accounts when reasonably necessary.

Grounds include suspected fraud, illegal or unsafe content, repeated non-fulfilment, excessive disputes, sanctions risk, payment-provider requirements, security threats or a material breach of these Terms.
Suspension or termination does not erase paid orders, refunds, disputes, taxes, outstanding balances or provisions intended to survive termination.
We provide reasons and advance notice where required by law. Business Creators normally receive 30 days' reasoned notice before full termination, except where a legal duty, urgent safety or security issue, fraud or repeated breach permits immediate action.

10. Content and acceptable use

Users retain ownership of content they submit, subject to the rights needed to operate and promote the service.

You grant Snaaail a worldwide, non-exclusive, royalty-free license for the duration of the relevant rights to host, reproduce, adapt for formatting, display and distribute submitted content solely to operate, secure and promote Snaaail and your offers.
Creators warrant that their names, images, copy, letters and products are accurate, lawful and do not infringe intellectual-property, privacy or other third-party rights.
You may not use Snaaail for fraud, harassment, unlawful discrimination, dangerous or prohibited goods, malware, spam, deceptive claims, rights infringement, sanctions evasion or interference with the service.

11. Complaints, disputes and reserves

Payment disputes do not replace the parties' duty to try to resolve genuine fulfilment issues promptly.

Members must not knowingly make false chargeback claims. Creators authorize Snaaail and Stripe to share transaction and fulfilment evidence reasonably needed to respond to a dispute.
If a Creator owes refunds, chargebacks, fees or other amounts, Snaaail may delay payouts, establish a reasonable reserve, debit an authorized payment method or offset amounts, subject to applicable law and notice requirements.
First send complaints to the Creator and support@snaaail.com with the order details. Consumers retain access to any court and out-of-court dispute procedure made mandatory by applicable law.

12. Responsibility and liability

Snaaail remains responsible for its own obligations and does not exclude liability that cannot lawfully be excluded, including fraud, gross negligence, personal injury or mandatory consumer rights. Snaaail is not responsible for a Creator's independent content, production quality or fulfilment. To the maximum extent permitted by law, Snaaail excludes indirect or unforeseeable business losses; for a business Creator, Snaaail's aggregate liability arising from the service is limited to the platform fees paid or payable by that Creator during the 12 months before the event, except for liability that cannot be limited.

13. Creator indemnity

To the extent permitted by law, a Creator acting for business purposes will defend and indemnify Snaaail against third-party claims, losses and reasonable costs caused by the Creator's content, offer, product, fulfilment failure, tax failure or breach of these Terms or law. This does not apply to the extent the claim was caused by Snaaail's own breach.

14. Changes to these Terms

We may change these Terms prospectively for legal, security or service reasons. Material changes will be notified on a durable medium where required. Business Creators will normally receive at least 15 days' notice and more when technical adaptation reasonably requires it, except where law, fraud or an urgent security risk requires faster action. Changes do not reduce rights already acquired under a paid order.

15. Account closure and survival

You may stop using Snaaail at any time. Account closure is subject to outstanding paid orders, scheduled subscription endings, refunds, disputes and balances. Terms concerning payments, taxes, intellectual property, disputes, indemnity and liability survive where necessary. We may retain transaction and compliance records for the period required by law.

16. Governing law and disputes

These Terms are governed by French law. A consumer keeps the protection of the mandatory law and courts of their country of habitual residence. Before litigation, the parties should attempt an amicable resolution; any mandatory consumer-mediation information must also be supplied by the professional responsible for the sale.
